Sublease of a rental property

You need the landlord’s consent to sublease parts or your entire rental property. In any case, the main tenant is also liable for any damage caused by the subtenants.

Contractual terms and conditions

Tenants shall notify SBB in advance of their intended contractual terms and the personal details of the subtenant. A copy of the sublease agreement must be given to SBB. In all other respects, Art. 262 CO applies.

Subletting on ‘Airbnb’ or similar platforms is not permitted without the prior written consent of SBB (Art. 262 Swiss Code of Obligations).

SBB is entitled to terminate the lease exceptionally if the tenant violates or fails to comply with the provisions of the sublet (Art. 262 Swiss Code of Obligations).
